Pastor Wiley Drake, who made headlines for praying for President Obama’s death, had a minor victory in a court case that seeks to question the legitimacy of the 44th president’s place in the White House.

A blog of the Los Angeles Times reports that a district judge has told supporters of the case that he will listen to “the merits” of their complaint. But it also notes that some observers think the case is a long way from a full court hearing.

The case is Alan Keyes, et al. v. Barack H. Obama, et al, and it was filed on Inauguration Day. Drake, a Californian who is a former second vice president of the Southern Baptist Convention, was on the 2008 California ballot as the vice presidential candidate teamed with Keyes, the American Independent Party presidential candidate.
